Frequently I get the question, Is the state is going to take my home if I go on Medicaid benefits? The answer is no. Homestead property is protected under Florida law, even while you’re on Medicaid. Once the Medicaid recipient passes, if the property is left to certain relatives, under Florida law it will not be collected or recovered by Medicaid. This is important to note, because Florida is unique and different than other states as it relates to the homestead.
