Florida Homeowners Who Paid MV Realty Penalty May Now Apply For Restitution

For several years we have reported about developments in the Florida lawsuit against MV Realty.  The company’s “Homeowner Benefit Program” was a scam that offered vulnerable seniors and others between $300 and $5000 in exchange for a 40-year lien on their homes. The predatory agreement gave MV Realty exclusive rights to sell the home, and if a homeowner wished to terminate the contract, MV Realty was to receive 3% of the home’s value.

The State Attorney General sued the company, and the Florida courts have eliminated all such liens. The final settlement also provides a process for homeowners who paid early termination fees to seek restitution. Dear Consumer,

After 3 years of contentious litigation, the Florida Attorney General has resolved our lawsuit against MV Realty and its principals Antony Mitchell, David Manchester, and Amanda Zachman.  The final judgment entered by the court requires MV Realty to release all liens or other encumbrances on all Florida properties, bans the three individuals who ran the business from ever engaging in a similar business, and required MV to pay $3 million for restitution, attorney’s fees, and court costs.

We believe the most significant victory in this hard-fought case is that MV must remove its unlawful liens from 9,303 Florida property titles.  As a result of our injunction, Florida homes are no longer encumbered by any MV liens and homeowners will no longer be “held over a barrel” by MV for 40 years with the threat of having to pay MV at least 3% of their home value at closing or other transfer of title.

Those who already paid a termination fee to MV Realty may be eligible for a payment from the settlement fund.  We will be reaching out to those consumers shortly to obtain information about the amount paid and will make distributions to consumers based on the total claims that we receive.  Only those who paid an early termination or breach fee to MV will be eligible to make a claim.  Please know that at this time there is no guarantee of the amount of restitution each consumer will receive.
